Terms & Conditions

General

1. Your Specs terms and conditions of supply

2. Any Order and subsequent purchase of Goods, (as defined below) or services from you shall be governed by the following terms and conditions. Please read them carefully. Please also view the Your Specs privacy policy.

3. These terms and conditions do not affect your statutory rights as a consumer.

“Your Specs” is the trading name, trading on the internet at www.yourspecs.co.uk. “We” / “Us” / “Our” refers to Your Specs, “You” / “Yours” refers to the Customer.

1. Customer Obligations

When you are purchasing spectacles, glazed sunglasses or contact lenses in our online shop, you confirm the following:

1. You are aged 16 or over and are not registered blind or partially sighted;

2. You are in possession of a written prescription for your spectacles that has been given to you by a suitably qualified person in the last 24 months (or 12 months if you are aged 70 or over); and

3. You are not buying glasses on behalf of anyone under the age of 16.

4. You will supply accurate details of your current prescription (including any notes on the prescription) when requested.

5. In the event of you not providing a Pupil Distance (PD) your optician has confirmed that the use of a default measurement will be satisfactory and have no detrimental effect on your well-being. For lenses, other than varifocals, we will normally use the default PD measurements.

6. To ensure and protect the health of your eyes we strongly recommend regular eye checks by a qualified person. We are not responsible for any incident that occurs due to any deviation from your prescription.

2. Making a Purchase and Orders for Goods

1. Orders to Your Specs must be submitted via the web at www.yourspecs.co.uk.

2. Submission of an Order represents an offer to purchase Goods from Your Specs, and we may confirm receipt of this offer via email (if the Order is placed via the Site).

3. Prescription Glasses orders are only accepted by us once your payment has been processed and they have been reviewed and authorised by a Dispensing Optician or Optometrist. In the case of the non prescription goods, your order is accepted once the required payment has been accepted or when the relevant goods are shipped, whichever occurs first. We will confirm acceptance of your Order via email or verbally.

3. Limitations of Supply

1. We are permitted and retain the right to make mistakes, such as typing errors, technical or colour deviations, or price modifications, despite our greatest care not to do so. We are entitled to contest the declaration of acceptance as defined in this agreement in all such cases. We also assume no liability whatsoever as to the accuracy of the manufacturer’s description.

2. We will make a reasonable effort to ensure that all Orders are fulfilled; however we cannot guarantee the availability of Goods. If the Goods you have ordered are unavailable, we will attempt to contact you to give you a choice to receive an alternative or a refund. If we are unable to contact you, your Order will be cancelled and you will be given a full refund.

3. On the advice of our Dispensing Opticians, we have absolute discretion as to whether or not to accept your Order.

4. If considered necessary or appropriate before an Order is accepted, Your Specs Dispensing Opticians have absolute discretion:

4. Payment and Prices

1. Prices stated are inclusive of any Value Added Tax (VAT) that may be required to be remitted to tax authorities by Your Specs.

2. We will use best endeavours to ensure the accuracy of the prices and price related information stated in our current catalogue and on the Site.

3. However we cannot guarantee that we will not make a mistake and misprice an item inadvertently. If this is the case, the Dispensing Optician reviewing and authorising your Order will notify you of the error before your payment is processed. You will then have the choice to either accept the correct price or to cancel your Order.

4. The price you pay is a retail price as appearing in your basket. In certain territories where we sell, we are required to report part of the sale price to the relevant tax jurisdiction and pay that amount in tax. We do not adjust our prices depending on the sales tax suffered which varies from country to country. And we do not add tax to any amount shown in your basket.

5. In some delivery countries there may be rules imposed locally that will charge import VAT to the purchaser. Your Specs is unable to provide any refunds for such costs.

6. When the order is placed at our website, credit card numbers are encrypted using 256 bit encryption. Online payments are secured with the latest SSL technology.

Delays due to cases of force majeure, disruption of transport or operative failures, strikes, shortage of raw materials and such like can lead to a reasonable extension of the delivery time. If delays continue beyond 4 weeks after conclusion of the contract, then each party is legally entitled to withdraw from this contract.

1. Should the delivered merchandise be defective or its warranted qualities flawed, or should it develop defects within the warranty period as a result of poor materials or faulty manufacturing, then we will either repair the items or provide you with a replacement. We are permitted to make multiple reparations. We reserve the right to refuse your choice of subsequent fulfillment if it entails disproportionately high costs.

2. The warranty period begins with the date of delivery and lasts for one year.

3. Once we have received the returned merchandise, we will refund the original purchase, minus any outstanding payments you may owe us.

4. All claims must be made in writing (email, fax or letter) and any defects communicated to us without delay as soon as they become apparent.

5. Upon discovery of any obvious deficiencies, and in order to prevent any further deterioration of the merchandise, you are obliged to inform us immediately. Failure to notify us of defects in good time will have no influence on our existing scope of warranty. Defective merchandise must be returned to us for inspection in the same condition at the time that it was discovered as being faulty.

8. Limitation of liability

1. We are exempt from being held liable for minor negligent breaches of duty, as long as they do not result in death or personal injury, or any breach of the statutory implied terms as to title of goods or claims according to the Product Liability Act. Furthermore, legal liability for breach of duties, which enables us to fulfill this agreement in the first place and in which the customer is entitled to trust, remains unaffected. The same applies to any breaches of duty by our vicarious agents.

1. Access to our Website is permitted on a temporary basis and we reserve the right to withdraw or amend the service we provide on our Website, at any time and for any reason, without notice to you. We will not be liable for any reason if the Website is unavailable at any time or for any period.
